September 16, 2005 - China joins the Hague Intercountry Adoption Convention

The People’s Republic of China deposited its instrument of ratification of the Hague Convention with the Netherlands Ministry of Foreign Affairs. China has become a "Hague Country" on January 1, 2006. China is the 67th State joining this global Convention.

China adoption programs placed almost 8,000 Chinese orphans with US families in the year 2005. China has been open to international adoption for over twenty years and, while other countries have drastically reduced opportunities for adoption, China has remained a constant. The allotment for single women is currently very small and preference is given to couples.

Commonwealth Adoptions International works with a partner agency to place children in China with American families. To date, Commonwealth has been able to assist all couples that have applied to adopt in China. Please call us for an up-to-date report on placement availability.

Commonwealth works with orphanages from Guangzhou to Wuhan to Beijing. Our China associates have excellent relationships with orphanages and they work hard to make your China adoption experience smooth and joyous.

time frames

From the time a dossier is logged in at CCAA, a referral will take:

- 23 to 30 months

The time frame for receiving your child referral from China is currently estimated to be about 24 to 30 months from the time your dossier is submitted and logged in at the CCAA. At time of referral, you will receive a photograph and very brief medical history of the child.

It is the presumption of the CCAA that you will commit to adopt the child they refer to you. If you choose not to adopt the child, then you may wait several months for a new referral, unless there is a discrepancy between the age, sex, or health of the child referred in comparison with your request.

In the case of adopting older children, the waiting time may be less. If this is your second adoption from China, there must be a full year between the first adoption and the date your second dossier is submitted to the CCAA.

requirements

- Couples who have been married at least 2 years if it is the first marriage for both spouses. Parents who have had a previous marriage need to be married for 5 years.
- Parents ages 30-45 can adopt a child under 18 months
- Parents ages 45-50 can adopt a child 18 months to 36 months
- Parents ages 50-55 can adopt a child through the Special Needs program.
- Parents' combined age cannot be over 100 years

Couples who have been married at least 2 years may adopt from China. Parents age 30-45 may adopt a child under 18 months. Parents 45-50 years old may adopt a child 18 months to 36 months. Parents age 50-55 may adopt a child throught the Special Needs Program. At this time, the CCAA is not accepting families who have a combined age over 100.

Minimum income per couple is $30,000, plus $10,000 additional for each child in the home, including the child coming home from China. The family must have a positive net worth of $80,000. Neither parent’s Body Mass Index (BMI) can exceed 40. The CCAA has strict requirements for the physical and mental health of prospective adoptive parents. Please be sure to contact the intake manager/adoption consultant in your regional office to discuss these requirements.

Special consideration is given to US citizens working in China, families with Chinese heritage, families under 45 years adopting children age 3 or older and families between age 45-55 adopting children age 6 or older. In these cases, the adoption paperwork is expedited.

The CCAA will review your Home Study carefully. Your Commonwealth China program Adoption Manager will give your Home Study Social Worker specific guidelines for composing the Home Study for China adoption.

Citizens of China, especially those who reside in rural areas, rely upon their sons for their future financial security. Because of current political, cultural and economic factors, some of the daughters of China are abandoned. The majority of children in orphanages are girls, abandoned anonymously in public places where they may found by local authorities.

Because orphaned children must remain in an orphanage for a certain length of time before they are made available for international adoption, the youngest child available is typically 8-11 months old.

- 2 to 3 weeks

Traveling to China is a wonderful experience. Our staff will meet you upon your arrival. All aspects of your comfort and appointments will be carefully orchestrated. All families report that a hallmark of their visit is the hospitality and courteous manner of the Chinese people. Families usually remain in China for two weeks.
